This Terms of Use agreement (hereinafter — the "Agreement") governs the relationship between OOO Traffic (hereinafter — the "Operator") and users of the website allcafe.ru (hereinafter — the "Site"). By using the Allcafe site, you agree to these terms; if you do not agree with them, please refrain from using the Site.
1.1. The Site is a restaurant guide — an information service about restaurants, cafés, bars and other establishments, gastronomic events and promotions.
1.2. The Operator may amend the Agreement unilaterally; the new version takes effect from the moment it is published on the Site.
2.1. All materials on the Site (texts, reviews, comments, photographs, design elements, logos, program code, establishment databases) belong to Allcafe (OOO Traffic) or are used on lawful grounds. Copying, reproduction and distribution of any materials from the Site without the written consent of OOO Traffic is prohibited.
2.2. Free use of materials is permitted only in the cases and to the extent established by Article 1274 of the Civil Code of the Russian Federation, including quotation for informational purposes to the extent justified by the purpose of the quotation, with mandatory attribution of the source (an active hyperlink to allcafe.ru).
2.3. Unlawful use of Site materials entails liability for infringement of exclusive rights as provided by Article 1301 of the Civil Code of the Russian Federation: at the rightsholder's discretion, either compensation for damages or payment of statutory compensation ranging from 10,000 to 5,000,000 rubles for each instance of infringement, as well as other liability in accordance with the legislation of the Russian Federation.
3.1. Without the prior written consent of OOO Traffic, automated collection of Site data (parsing, scraping, crawling), as well as mass extraction and reuse of Site materials and the contents of its databases by any software means, is prohibited.
3.2. The use of Site materials to train artificial intelligence systems and machine learning models without the prior written consent of OOO Traffic is prohibited.
4.1. By publishing a review, you confirm its authenticity. Paid, offensive and false reviews are not published (see the review publication rules).
4.2. By publishing a review, comment or photograph, the user confirms that they are the author thereof or hold the necessary rights, and grants the Operator the right to use these materials on the Site (a simple non-exclusive license, free of charge, for the term of the exclusive rights).
5.1. Information about establishments (operating hours, prices, menus, promotions) may change; the administration bears no responsibility for decisions made on its basis or for any discrepancy between the published information and the actual state of affairs at the time of visiting the establishment.
5.2. Users are solely responsible for the content of materials they publish and for any infringement of third-party rights.
6.1. The processing of users' personal data is carried out in accordance with the Privacy Policy and Federal Law No. 152-FZ "On Personal Data" dated 27.07.2006.
